Abstract
Capital trial penalty phase transcripts (n = 94) were analyzed for the presence of expert witness testimony. Early child abuse emerged as the most common mitigator presented, and the presence of an expert was unexpectedly associated with more death judgments, though the findings did not reach statistical significance.
