Motions in Limine and the Temporal Dimension of Neural Processing of Moral Reasoning and Emotional Judgment: Does Evidence Really Inflame Jurors’ Conscience?

Abstract

Granting of motions in limine presume that inflammatory evidence causes disgust so overwhelming that a moral judgment will be automatically registered. This study examined the time course of neural processing of moral reasoning and emotional reaction. Results indicate the former may precede the latter. Applicability to criminal law is presented.
