The Probative Value of Non-Identifications

Abstract

A non-identification is when an eyewitness states that the perpetrator of the crime is not present in the lineup, which could suggest that the suspect is innocent. We investigate how jurors perceive non-identifications. Two studies demonstrate that non-identification testimony does not reduce convictions unless accompanied by a sufficiently detailed explanation.
